A lawsuit refers to the civil legal action brought in the court of law. Civil law is initiated when one party is suing another party for money or property. Civil law can be filled by an individual, business organization or government agencies.

If you really feel unjust and want to take a legal action against the other party for infringement of the civil right then you can initiate a legal proceeding against the other party but do keep the following points in mind before filling a case:

  1. To initiate a legal action a person must be at least of 18 years of age otherwise he would be considered legally disable. "Legal disability" - means they have limited litigation rights as prescribed by the law. Legal disability also includes people who are judged mentally incompetent because of illness, age, or infirmity. But it doesn't mean that people in these categories are removed from civil cases. Law has given them privilege under which a legal representative like a parent, guardian, trustee etc. can assert the claims or defences of a legally disable person.
  2. If there is a condition where a defendant feels that the plaintiff in a lawsuit should have sued someone else then he has got a provision to bring that other person into the case by prior permission from the court.
  3. Sometimes people ignore a civil summons but ignoring a summons is never a good option. If you receive any legal summon you must discuss it with lawyer first because summons is also an important part in a civil suit. A civil summons refers to a legal document informing the person that a lawsuit has been filed against him or her, and that a response is required by a set date and time.
  4. In civil cases, appeal is an important process. Once lower court has issued its final ruling any party either plaintiff or defendant, winner or loser has the right to appeal a lower court's judgement before a higher court.
  5. Before filing the case a person always thinks of the money going to be spend in the entire procedure. The first expenditure for fighting a case is the court fees. Different amount of court fee is paid for different type of documents and cases, so be cautious while paying for your case. Also, a lot of money is spent on lawyers while fighting a case. Do check if you are not getting extra charged and also discuss with him the probability of winning the case.
