Canada Temporary Foreign Worker Program

The Temporary Foreign Worker Program provides a temporary solution to Canadian employers facing scarcity in the workforce. Although, as a general rule, it is mandatory to acquire a Canada work permit to be eligible to work in Canada under the TFW program.


Acquiring a Canada work permit involves a multistage process that may take several precious weeks to complete. Based on one’s intention to work in Canada, there are several ways to obtain a Canada work permit. To get a temporary work permit granted by the Canadian government, employers must provide foreign workers approval from ESDC or an offer letter issued by IRCC. 


Foreign workers must acquire a Temporary Resident Visa (TRV) to come to Canada, depending entirely on their country of residence.



How the Temporary Foreign Worker Program Works? 


Step 1: Labour Market Impact Assessment


Canadian employers who wish to hire a temporary foreign worker must obtain a neutral or positive Labour Market Impact Assessment (LMIA) from ESDC. The only condition is that employers should ensure that there’s no Canadian or permanent resident available to perform the job. Moreover, if the employer needed a candidate for Quebec provinces, the Canadian employer needs to acquire CAQ to work in Quebec. 


A positive LMIA means that a vacancy is not filled by a Canadian citizen or permanent resident, thereby allowing an employer to recruit a foreign national.


A negative LMIA is an indicator that a Canadian citizen or permanent resident is available to fill the position in demand. 



Step 2: Temporary Job Offer


After securing a positive LMIA, the Canadian employer extends the LMIA approval letter accompanying a job offer to the foreign worker. Once receiving a valid and detailed job offer, a foreign worker can apply for a work permit for Canada. 



Step 3: Canada Work Permit


The foreign workers need to submit their application for a work permit to IRCC after getting an LMIA approval letter and the employment offer letter. The Canada work permit is valid for a specific period. 



Step 4: Work Permit is Issued 


The Canadian work permit for temporary employment will be issued at the time of arrival in the country. It may be issued for a few years depending on your needs. Most of the work permits for Canada are employer-specific and are issued for specific jobs in Canada. Therefore, a foreign worker can work only for the employer stated on the work permit. If in case the foreign employee finds a different job offer and does not have a permanent resident status yet, the foreign employee must acquire a new Canada work permit before switching the employers. 



Canada Permanent Residency Status


Remember that a work permit is issued to those foreign individuals who intend to work in Canada for a specific period. To live and work in Canada as a permanent residence, the foreign workers must undergo the permanent residence protocol. A temporary work permit may, however, be a stepping stone to a permanent residence in Canada. Once a temporary work permit has been obtained in Canada, a foreign worker can qualify for permanent residence in Canada under the Canadian Experience Class (CEC), through a Category of Skilled Workers, or one of the Provincial Nominee Programmes.

The Temporary Foreign Worker Program helps Canadian employers to hire foreign nationals for the vacant positions that the Canadian citizens are unable to fill. This ensures that these temporary workers are granted the privileges and security they deserve to be working safely in Canada. Employers can appoint temporary workers for the various streams listed below: 


  • High and low-wage Workers

  • Global Talent Stream

  • In-Home Caregivers

  • Foreign Agricultural Workers

  • Foreign Academics


There are several options for temporary workers that allow employers to hire employees without needing an LMIA. These options are arranged as part of the International Mobility Program responsible for producing applications for LMIA-exempt work permits.



International Mobility Program


The International Mobility Program (IMP) allows Canadian employers to recruit international temporary employees without needing a Labor Market Impact Assessment (LMIA). While most employers recruiting foreign workers would need an LMIA, there are some situations where there are LMIA-exemptions. The following conditions are used to justify these LMIA exemptions:


  1. Cultural, broader economic or other competitive advantages for Canada.

  2. Reciprocal advantages enjoyed by citizens of Canada and permanent residents. 


To recruit a foreign temporary worker through the IMP, the employer must abide by these three steps: 


  • Confirm the position or worker in questions qualifies for an LMIA-exemption;

  • Pay the employer compliance fee of CAD 230;

  • Submit the official job offer through the IMP’s Employer Portal.



The foreign national will only be eligible to apply for his work permit after completing these three steps.
