Everything You Need to Know Regarding Surrogacy in Russia

Most of the intended parents from the US opt for surrogacy in Russia due to the affordable cost of surrogacy in Russia. Moreover, the Russian law is quite supportive for every foreign couple who hasn’t been able to pursue their parenthood dream within their own country.

Surrogacy law in Russia

Surrogacy stays legal in Russia as per the given provisions of the federal law on the basic of health protection of citizens of the Russian Federation, which was published in January 2012.

The law permits all the couples (married or unmarried/ local or foreigner) to pursue a gestational surrogacy arrangement within the country, subject to their fulfilment to the below mentioned criterion-

• Only heterosexual couples and single females can participate in a gestational surrogacy arrangement with gestational surrogacy agencies in Russia with a prohibition on same-sex couples in the same respect.

• Only gestational surrogacy Russia arrangement is permitted and the surrogate mother cannot use her own eggs to get pregnant. Instead, she is required to use the eggs of the intended mother or the egg donor agency Russia.

• The intended mother has to prove her inability to get pregnant or carrying a child for the full term. She must be coming with a medical reason in the same context.

• Single mothers are required to use their own eggs for the embryo development that is then going to be implanted into the womb of the gestational mother.

On the other side, not every woman can become a surrogate mother in Russia and the same federal law lays down several requirements for a woman to become a surrogate mother in Russia.

The women must be aged between 20 and 35 years while being healthy in both physical and mental aspects. She must also have carried a child of her own in the past without any major complications.

In case if the surrogate mother is married, she has to take the consent of her legal husband to enter into the surrogacy program in Russia.

Intended parents to get registered as the legal parents for the child

As per the article 51, the written consent of the surrogate mother is required in order to include the name of the intended parents into the child’s birth certificate. On the other side, article 52 states that once the name of the intended parents is included in the birth certificate, they will be deemed as the legal parents of the born child.

Once the intended parents have secured the consent of the surrogate mother along with a document issued by the medical authority confirming the same consent, they can now proceed towards registering the child at the civil registry office.
