The Basic Concept of Court Marriage Procedures in India

Marriage through court marriage widely followed and practiced in India, where the couples can get married without lengthy rituals and civil ceremonies. The concept of the court marriage procedures are explained in this article in detail. The basic conditions that the couples should meet for applying for the intended marriage application are precisely described in the Chapter ii and Section 4 of special marriage act of 1954. Broadly speaking, the court marriage procedures can be divided into 6 simple steps for better understanding of the readers.

First step of the court marriage procedure is a notice in writing for application of intended marriage that should be submitted in precise format to the marriage registrar office where at least one of the parties has resided for more than 30 days.

The notice of the intended marriage should be submitted in the specific format that is described in the schedule ii of the special marriage act of 1954.  Along with the marriage application form, the both of the parties have to submit documents attached as proof of age, proof and residence.

Step 2 of the court marriage procedures consists of the publication of the notice of the marriage applications form by the marriage officer at the place in the registrar office and one copy on the office of the district where the parties stays permanently. 3rd step of the court marriage procedures is no objection to the marriage application form.

If the marriage application form receives no objection then the marriage can be solemnized after the 30 days of the submission of the marriage application form to the marriage registrar office.

Declaration should be signed by both the parties along with the three witnesses in front of the marriage registrar officers. The declaration will be counter signed by the marriage registrar officers in Delhi.

The next step of the court marriage procedures is choosing the place and form of marriage. Marriage certificate as described in the schedule IV of the special marriage act is entered by the marriage officer in the marriage certificate book of the marriage registrar office in Delhi.  The certificate is proof of the court marriage procedures and is signed by three witness and both the parties.
