Important things you should know about civil judgement

by Alan M. Cohen LLC Debt Collection Lawyer in Boston

You may have come across many individuals stating that a civil judgement has been issued against them and they want to know what options are available for them.  In maximum cases, they take help of the attorneys to help them with the best possible options.

A civil judgement is a verdict against a defendant in the court of law. It is a non-criminal legal case and often requires the defendant to pay for the damages, and that too in terms of monetary amounts.   The legal case starts when a plaintiff wants to sue a defendant and a complaint is filed with the jurisdiction where the issue took place. In the case of civil judgement, the court or the jury decides that one party is the victor. Everything is well-written in the judgement like how much money is owed from the debtor to the creditor. Also, it includes the legal costs of filing the legal suit and the interest rate that can accumulate on the debt.

Sometimes, many are confused between the cases of a civil judgement and criminal conviction. The simplest way to find out is who actually is accusing the individual for wrongdoing. In case of criminal conviction, the culprit is suspected of breaking laws set by the laws. So, the prosecution represents the state. But in case of civil cases, the allegations are made by a plaintiff against a defendant. The civil cases may include probate cases, wrongful deaths, small claim cases, wrongful death cases, family law cases and more. These cases are decided by a jury or simply a judge depending upon the scope and severity of the case.

According to attorneys with experience in civil and foreign judgement cases, the costs, fees and sometimes the attorneys fees get added to the judgement. You can even find an increase in the interest.   You should also note here that any judgement entered can appear in the public section records of your credit score. If the judgment is against you, it can also bring your credit score down significantly. Also, it will remain on your credit for many years, even when you have cleared the debt.  The report will be just updated to satisfied but not removed completely. These judgements can be appealed too. The judgment is not final until the time period for the appeal has expired. An experienced lawyer can help you in such scenarios. The attorney can tell you how to proceed in such cases.
