Although there are as many different types of personal injury cases as there are types of injuries, there are also a few basic steps to follow in pursuing a compensation settlement. Whether you're hurt as the result of medical negligence, slip and fall injury, motor vehicle accident. or as the result of a defective product, the compensation law covers a magnitude of incidents. No two compensation settlements work the same, and much of it depends on the severity of the injuries resulting from the accident. Whether or not the incident was covered by insurance, and who was at fault, are two more key issues.

When filing for a compensation settlement, follow these practical tips:

1.  Find out whether your injuries are covered by an insurance policy

If you are injured and feel that someone else is to blame, find out whether their insurance coverage will cover your claim. If you were involved in a motor vehicle accident, find out if the other driver is insured. In a slip and fall accident, find out if the property owner has liability cover.

Knowing whether there is insurance is important in determining whether you would be able to collect a compensation settlement, because without insurance, even if the judgment is in your favour, it will be worthless without suitable insurance. In that case, your own insurance might provide sufficient cover. However, if your injuries are significant and the other person was clearly at fault, you should proceed with your claim. They can sort out the details.

2.  Consider Involving an Attorney

In the simplest of cases, where your injuries are insignificant and you're confident that you will get a satisfactory result on your own, it's probably best to discuss the issue with a specialist in personal injury law. Find an attorney who will offer a free case assessment and who works on a contingency basis, because they will not charge you unless they reach a settlement on your behalf.

3. Decide whether you will file a lawsuit

In many cases, compensation settlements are reached out of court and most are resolved before a lawsuit is filed. You don't always have to go to court to receive compensation. Third party claims can be filed against the insurance carrier of the at-fault party.

Sometimes, negotiations can break down, at which point you may want to engage the services of a personal injury lawyer who specialises in compensation law can file your claim and pursue a compensation settlement on your behalf.
