What type of attorney does one need for lemon law?

by Andrew Richardson allenstewart

The Washington State Lemon Law is created to help new-vehicle owners. These are the consumers who have continued problems with warranty repairs for substantial defects. This law allows the owner to request an arbitration hearing of Lemon Law disputes with vehicle manufacturers through the Attorney General's Office, along with other benefits.

So you have some options to resolve your dispute. But when things don't work out as desired, you can consult with an experienced lemon law attorney. Lemon laws aren't simple, and you may need expert counsel to negotiate with manufacturers.

How do you define a lemon?

Your vehicle may qualify as a lemon. But the requirement includes one or more significant defects subject to an appropriate number of attempts to diagnose or repair the problem or problems; all this under the manufacturer's warranty.

Substantive defects are those that are

1 - Life-threatening

2 - Pose a risk of fire

3 – Considerably reduce vehicle reliability and resale value

Defects due to misbehavior, negligence, or modifications made to the vehicle by the owner do not hold under this law.

What should you do if you have Lemon?

When you realize that your recently purchased vehicle is a lemon, you can

1 – Connect with Lemon Law Administration for details and request Arbitration Form.

2- Check on Motor Homes for additional requirements if your vehicle is a motor home.

3 - Dispatch the manufacturer a written request to buy back or replace your defective vehicle as part of your Lemon Law claim.

The manufacturer has 40 days to respond after getting your written request for a buyback or replacement.

Irrespective of the 40-day reply period, a request for Arbitration must be received by the Lemon Law Administration within thirty months of the original purchase and delivery of the vehicle.

The need to consult an attorney

You may think whether you need a lawyer under the Washington Lemon Law claim or not. You can resolve your case, but you stand to succeed if you have a skilled Lemon Law lawyer to represent you.

And why? The legal process related to a Lemon Law claim can be complex. And the manufacturer is likely to deny responsibility or provide you with an agreement that is substantially less than your claim. A competent lawyer can ensure that your interests are protected throughout.

You need a Washington Lemon Law lawyer if your case cannot settle out of court through negotiations between you and the manufacturer. Connect with an advocate who has the experience to take your case to a conclusion in your favor.

Conclusion

Discuss your lemon situation with a competent attorney who is well-versed with State Lemon Law in Washington
