Watch Your Tongue! – Insurance Adjusters

by Kristen White Blogger

Immediately after a car accident it is common to be in shock and traumatized by the event. However, after a few hours, days or weeks some victims have been known to almost bounce back to their normal selves. It is often during these crucial moments after the accident that insurance adjusters surface in order to make assessments with regards to the accident. It is possible that they will be two insurance adjusters to do the assessments; one would be from your insurance company while the other would be from the other driver’s insurance company. This article will discuss why it is important to watch what you say when speaking to an insurance adjuster after the accident.

Talking to any insurance adjuster after a car accident can often lead to direct consequences relating to your personal injury claim. Often, insurance adjusters are known to ask leading or tailored questions that when a response fits a specific line of events can have an adverse effect on one’s case.

After car accident that injures an individual, the next issue that comes up is who is legally liable for the accident. It is important to note that insurance companies have an interest in protecting the finances of the insurance companies. As such this interest is often accomplished by refusing or denying as many claims as possible and negotiating for the lowest possible settlements on other claims.

Therefore, after the insurance company is informed about an accident, they open an investigation in order to determine who was at fault for the accident between the drivers involved. To do the investigation they assign an insurance adjuster. In instances where both drivers share fault, the insurance company may work at apportioning a certain degree of fault to the other party. In instances where the victim is able to prove damages the insurance adjuster is likely to make an offer in order to settle the case. However, most often than not the settlement offer is less than the actual damages that the victim suffered. All this ties back to the fact that the adjuster is protecting the interests of the insurance company. Thus, the insurance adjuster is not motivated to help the victim get what they deserve. So, no matter how friendly or concerned the adjuster may be to the victim, this very well may be a facade of trying to make the victim slip up and say something that will undermine their case.

One of the key roles of an insurance adjuster is to extract as much information from the accident victim in order to use this information against them. This is applicable to all insurance adjusters whether it is for your or the other driver’s insurance company. Often, parties involved in an accident feel inclined to be open and honest with insurance adjusters with the expectation that they will be treated in a fair manner. In addition, people assume that they know the laws that relate to accident cases and think that they have a good case. However, they may be unexpected legal pitfalls.
