A unitary patent system will be the most significant change
in the European patent system in decades. A unitary patent is a single patent,
also known as a European patent, providing uniform protection across all
participating EU member states, except Spain, Croatia, and Poland, which are
not currently participating in the system. A unitary patent offers broad
protection with a business-friendly level of renewal fees. A unitary patent is
a cost-effective system that reduces the complexity and the associated costs.
The new unitary patent system will make the European patent
system much more straightforward and significantly reduce the cost. It will
eliminate the need to comply with validation requirements in the participating
member states. Instead of validating their European patent in many forms, an
expensive, time-consuming, and complicated administrative process, patent
proprietors can obtain a unitary patent by filing a single request with the
EPO. The unitary patent court will begin with 17 countries; seven have signed
the UPC but still need to ratify it. The unitary patent is expected to launch

There will also be no need to retain different local
attorneys, agents, or specialized service providers for a unitary patent.
Several renewal fees may vary in amount and currency in the existing system and
can be paid to different national patent offices subject to additional legal
requirements. Unitary patent owners pay one renewal fee to the European patent
office in one currency (i.e., in euros) and under a single legal authority
regarding deadlines and permitted means of payment. This system will
significantly simplify matters for users.
The renewal fee level is appealing and business-friendly as
it is set at a level equivalent to the combined renewal fees of the top four
countries among the participating Member States.
The unitary patent
fees will be payable to the EPO annually. It will be due at the end of the
calendar month containing the anniversary of the filing date. If you cannot pay
the renewal fee within that period, re-establishment will be possible, but this
will require proof that the deadline was missed despite all due care being
taken.
Payment handling and procedures are simplified in unitary
patents, and the renewal fee payment has been improved. As per the current
agreements, renewal fees at the EPO can be paid from the third year after
filling. It can be delivered to the national patent offices where the granted
