Cannabis Legalization Kentucky

In 2019, the Kentucky General Assembly passed a law legalizing medical marijuana in the Bluegrass State. The new law, dubbed Senate Bill 12, allows qualifying individuals with certain medical conditions to obtain cannabis products from designated dispensaries. The law also allows physicians to recommend medical marijuana to their patients with certain medical conditions. The bill took effect on April 29, 2019.

Kentucky Cannabis Company has been slow to adopt pro-marijuana reforms; the law came three years after its neighbor, Ohio, approved medical marijuana in 2016. Currently, medical marijuana is legal in 33 states plus the District of Columbia, making Kentucky far behind other US states in marijuana reform.

Though the bill sets out clear qualification criteria, it does not provide any details on how the medical marijuana would beregulated by the state. The details remain in the hands of the state government, which will have to create a regulatory board responsible for all aspects of running a medical marijuana program.

In addition, the state will have to license dispensaries as well as set regulations on potency and types of products available. It will also be responsible to regulate taxes and other fees associated with the program, along with cultivation and distribution.

Kentucky Medical Marijuana

To qualify for medical marijuana in Kentucky, patients must first get a physician’s recommendation stating that marijuana is necessary to relieve symptoms of their condition. The state will only accept recommendations from a licensed doctor, physician assistant, or nurse practitioner.

The bill specifies that the qualifying medical conditions are chronic pain, including opioid-use disorder, glaucoma, HIV/AIDS, cancer, ALS, Crohn’s Disease, post-traumatic stress disorder (PTSD), seizures, multiple sclerosis, Parkinson’s

Disease, sickle cell anemia, Ehlers-Danlos Syndrome, and other conditions that may be added to the list by the state. By obtaining certification, these patients can gain access to medical marijuana products, such as oils, edibles, vapors, and dried flower.

Though no details have yet been released on the type of products that will be offered in Kentucky dispensaries, patients can expect to see the same products found in other states. Patients can find products containing varying degrees of THC, as well as high CBD products that provide little to no psychoactive effects.

In addition to setting up a medical marijuana system, the newly legalized Kentucky legislation also allows the Hemp Commission to develop a hemp industry for the state. Hemp can be used to making products such as lotions, clothing, and even food.

Advocates for marijuana reform are hoping that the legislature will also pass laws that legalize the recreational use of cannabis. Currently, only 11 states and the District of Columbia have legalized recreational use of marijuana. However, it is likely that more states will follow suit in the near future, given the growing pro-cannabis sentiment sweeping the nation.

Though Kentucky's marijuana legislation is a long time in the making, it marks an important step forward for the state. With the new law, marijuana will now be legally available to those who need it for medical reasons, while also opening up the possibility of a hemp industry. As Kentucky moves forward in cannabis reform, advocates will be watching to see how the state takes the next steps in expanding both the medical and recreational markets.
