OVERVIEW
In 2017, an amendment was considered to the Maternity Benefit Act, 1961 that is called Maternity Benefit (Amendment) Bill 2017.

APPLICABILITY
Applicable for all the women employment under factories, shops, mines, plantations, government relevant bodies.
Applicable legislation and Central Government bodies
ELIGIBILITY
The woman employee must have been working in organization for a period of at least 80 days in the previous 12 months.
They must have paid on the average daily wage for the period of actual absence.
Key highlights of the Amendment
Section 5(3)
• Provided 26 (twenty-six) weeks of paid Maternity leave for the first two child
• 8 (eight) weeks prior to the date of expected delivery date
• No increased benefit for the third child
• 6 weeks pre and 6 weeks pro the delivery leaves for the third child
• 12 weeks leave to a woman who adopts a child below the age of 3 (three) months
• 12 weeks leave benefits are availed by a commissioning or surrogate mother
Section 11(A)
• A mandatory creche facility in every organization having 50 (fifty) or more employees
• Women employees are allowed to visits 4 times during the day to the crèche.
Section 5(5)
• Also describing “work from home” for the women employee
• Depends upon the nature of the work assigned to a woman and mutual understanding of an employer and employee.
Section 11A(2)
• Inform the woman employee about the Maternity Benefits Act at the time of joining.
