How to Know If You Are Eligible For The Oregon DUII Diversion Program?
 
You are eligible if you meet all of the criteria listed below:
 
  • You don’t bear any charge of a DUII or similar charge in any other jurisdiction, except the present offense, pending on the date you file the petition for a DUII diversion agreement
  • You are not part of any other DUII diversion program other than a program you are presently enrolled for your present offense, in this state or in any other jurisdiction on the date you file the petition for a DUII diversion agreement
  • You are not charged of any strong felony like manslaughter, murder, criminally negligent homicide etc. that is the outcome from the operation of a motor vehicle pending in any other jurisdiction or in this state on the date you file for DUII diversion agreement
  • You did not possess a Commercial Driver License (CDL) during the time of the offense
  • You were not in operation of a commercial motor vehicle at the time of the offense
  • The present DUII offense is not involved in physical injury or accidental death of any person other than yourself
  • You are not convicted of a felony DUI / DWI/DUII in Oregon or anyplace else.
 
What Is Required To Enroll Into The Oregon DUII Diversion Program?
 
If you want a successful completion of the DUI program, you must:
 
  • Undergo a Drug Evaluation Test
  • Pay assessments, fees and other expenses to the court, to the evaluator, and to the treatment provider
  • Complete the necessary DUI courses
  • Attend a one-time victims panel class
  • Not consume any non-prescribed drugs/alcohol for a year;
  • Install an ignition interlock device on every vehicle you drive during the one year diversion period 

What Would The Diversion Program Cost?
 
Generally there are no fines associated with diversion. However, the treatment fee depends on which service provider you select and the length of your treatment. Note that the providers' fees vary widely so check with your health insurance for all possible coverage and call for details.
 
Does the Diversion Program Vary From County To County?
 
It does not. The rules and requirements are same for all Counties.
