What is Statutory Declaration and its use?

During a Statutory Declaration, you sign and verify that you are making a true and correct statement. In exchange for signing it, you certify that the information it contains is true. If it is false, you could face criminal charges. Depending on the offense, you could receive a fine and/or incarceration for years.

Statutory declarations, such as, serve many purposes

1. verify insurance claims

2. Prove your age

3. Apply for sick leave at work.

Find an authorized statutory declaration witness.

Following the statutory statement, it is necessary to have it witnessed by one of the numerous people authorized to do so, including:

1. Notary Public

2. Lawyer

3. Commissioner of Oaths

4. Court Registrar

5. Justice of the Peace

Please note that:

A witness who is authorized to sign a statutory declaration does not have to accept the request.

An organization may not witness a statutory declaration if it employs people who are authorized to do so.

It is best to ask ahead of time whether a witness will be available at a convenient time and place to witness a statutory declaration.

Sign and initial each page

In each other’s presence, you must do both:

1. If the statutory declaration is altered in any way, sign or initial any changes

2. sign or initial each page, if required

A certificate identifying the document as an exhibit to the statutory declaration must be attached to the declaration if the declaration refers to a separate document.

As a statutory declaration requires a witness.The witness must sign the certification and include their qualifications.

• Sign and date the last page

• In the statutory declaration, the last page must be signed and dated.

In addition to the signing, typing, or stamping, the witness must include:

1. their name

2. address (personal or professional)

3. their qualification as a statutory declaration witness

There are times when you may need help making a statutory declaration, such as if the document needs to be translated.It is also necessary to have someone assist you by audio-visual link when you sign the statutory declaration.Before the statutory declaration is finalized, the person assisting must receive a copy of the statutory declaration signed by the declarant (the person making the statutory declaration) and the witness.

They must write or type:

1. their name and address

2. an explanation of what kind of assistance they provided
