Access to Abortion is Legal in India

Yes, you heard it right! Abortion in India is legal up to 20 weeks of pregnancy under the grounds of Medical Termination of Pregnancy (MTP) Act, 1971. It is legally permitted under circumstances as per the MTP Act. These conditions include:

  • If a continuation of pregnancy leads to any physical and mental risk to the life of the mother.
  • If an embryo is suffering from severe abnormalities.
  • If pregnancy occurs from the failure of contraceptive. (only valid for married women)
  • If pregnancy occurs from a rape.

Is consent required for termination of pregnancy?

If you’re a minor (below the age of 18 years) or have any mental illness: Consent of the guardian is required who is able to take care of the minor woman. It is not compulsory that only parents are needed to consent.

If you’re an adult (above the age of 18 years): A woman can terminate a pregnancy with only her consent.

Methods of Abortion

There are two safest methods of abortion available for women in India. It involves:

  • Medical Abortion: It is performed with abortion pills to stop the growth of pregnancy in a female reproductive system. It can be done up to 9 weeks of pregnancy from the first day of last period. No anesthesia, surgery or medical instruments are involved in this procedure. It is more similar to a natural miscarriage.
  • Surgical Abortion: It is also known as aspiration abortion or suction abortion. It is conducted using medical instruments in the vagina and uterus to remove the tissues of pregnancy. The procedure takes just about 15 minutes. It causes less bleeding than a medication method.
