The Party Wall Act – Implications for all Parties by Expert Surveyor

by Tim S. Be the best
The Party Wall Act 1996 includes support to prevent and resolve disputes that may arise regarding the party walls, excavation near adjoining buildings, and boundary walls. A building owner planning to start work covered under the Act should provide all the owners with notice. The notice must include what work will be done as they are set down by the Act.

What Does the Party Wall Act Cover?

The Party Wall Agreement guides you as an owner if you decide to carry out any building work which falls under this act and what you should do if your neighbor decides to perform work that may affect you. The Act covers the following:

  • Excavation below the foundation of a neighbor’s building or around it
  • Renovation or new work to a pre-existing party wall or structure
  • Construction of new buildings near or on the boundary shared by two owners
  • This includes constructing a wall shorter, taller, cutting into the wall, building a new one, and the likes

The Role of the Party Wall Surveyors

A Party Wall Surveyor London forms a Party Wall Award. This document can be appealed to the Country Court within fourteen days of the notice being served to you. In case of a delay or if the document is not appealed to the court, the award is in binding to both the owners.

  • The award constitutes a record mentioning the condition of the adjacent property if in case there is a damage claim, copies of drawings, and it also states the rights and duties of the owners.
  • The award determines the procedure of the work, like the manner of execution and time, it will include any other matter that may have arisen because of a dispute including the cost of forming the award.
  • The surveyor or the party wall specialist decides whether any damage caused during or after work is the result of the work or the condition of the building. The surveyor then decides the amount of compensation if the owners cannot come to a decision.
  • Security for expenses is also dealt with by the party wall expert. If it is demanded and determined, it should be sent to the building owner or be utilized for the reasons it was requested for.

Party Wall Surveyor Fee

The building owner who comes up with work, under normal circumstances, takes the responsibility of paying the adjoining owner’s party wall surveyor fee. Usually, an advising engineer is also hired, in which case their cost is also determined. You will be able to fix a fee amount with your own party wall surveyor, but that might not be the case with the other surveyor.

Party Wall Expert

A Party Wall Surveyor North London or Party Wall Expert will provide the owner cost-effective and unbiased advice to guide the owner through any obligation. A Party Wall specialist will minimize the cost and delays in your work.

If you receive a party wall notice, your surveyor will make sure the neighboring owner is compliant and is taking all the steps to protect your interests.
