Not Sure About Grandparents Rights? Read This...

by Ranny Watson Blogger

In the upbringing of children, grandparents play a very important role. The education, moral values, and the mindset which children develop, grandparents play a very important role in it.

We recognize the important role that grandparents and the extended family can play in children's lives and that, as a result of conflicts between the parents of an infant, they are most frequently the first family members to be alienated.

What are grandparents rights

Talking about the actions that grandparents can take, they can make an appeal to the court to see their grandchild or they can attempt to maintain a healthy relationship with the ex-partner of their child in the event of a relationship breaking down or separations. It is necessary that you do not allow yourself to become involved in their conflict with their ex-partner, despite the fact that your child is suffering and unhappy with the breakup.

To all the grandparents out there, it is important that you keep in touch with your grandchildren without being seen to take sides. To the parents let them, as they will always be a parent to your grandchildren regardless of what you might think of the ex-partner of your child.

In the United Kingdom, do grandparents have legal rights?

Grandparents in England do not have a right to see their grandchild, and they do not have automatic parental responsibility either. By applying for a Parental Responsibility Order, it is not possible for grandparents to obtain parental responsibility.

However, while grandparents do not have legal rights to see their grandchildren, parents do have legal rights to choose who their kids see. There is provision for grandparents to make an application for an order in relation to the time they spend with their grandchildren if agreement can not be achieved.

Should grandparents petition for access to grandchildren in the courts?

For a court order, only persons with parental responsibility can apply. Grandparents may, however, request permission to request a court order to pursue contact with the grandchild. It is very unusual for a court to deny permission from grandparents to make an appeal. The court will consider at the hearing:

  • The relationship of grandparents with grandchildren

  • The essence of a request

  • If contact with the grandparents was detrimental to the child in some way,

  • If the interaction with the grandparents continues, the rest of the family will be adversely affected.

You will have to attend a full hearing with the parties presenting evidence in the case of parents raising objections. A lawyer with experience in the legal rights of grandparents will be able to help illustrate that the lives of grandchildren will be improved and will benefit from interaction with grandparents
