How to recover debt from an unwilling person?

It can take lot of time (and a lot more money) to obtain papers signed by a judge stating that you’ve won your lawsuit, and you’re owed money. But what if the person you sued owes you money, and still hasn’t paid? What can you do? You do what a logical person would do: You call your judgment debtor and politely say, "Please send me a cashier's check as soon as possible. I have won the case against you. Thank you," and then he delivers you a check, right? Not likely. Don't forget, this is the same person who refused to pay you in the first place. He isn't going to pay you unless he HAS to.

So, again, what can you do?

If you have time, patience and some knack for the law, doing the enforcement yourself can be a viable option. Unfortunately, given the increasing complications of judgment enforcement laws, and the rather dire situation of courts and sheriff's offices due to budget crisis, going it alone is becoming increasingly challenging.

 

A far more effective option is to hire a collection attorney. Reluctant debtors are much more responsive when they are dealing with an attorney. Instead of constantly being given the runaround, a collection attorney can persuade debtors to take action.
