Before removing tenants from our property, different eviction processing steps are included like notice,file the lawsuit

Notice for termination with cause

The eviction process varies from state to state,there are three basic steps included in notice processing by landlords to tenants due to the misbehavior of tenant

·         Pay rent or  quit notices : when tenants re not paying the rent, the landlord will give quit notice or pay rent notice to pay the rent or move out

·         Cure or Quit notices : when teanat does not obey the terms and condition as mentioned in the rental agreement then landlords have right to give this notice. Usually the tenant will set an amount of time for curing such malpractice, if they fail to keep the promise then landlord have right to eviction lawsuit

·         Unconditional Quit Notices:In which means landlord order he tenant to vacate the lease property without any pre-demand . It is mainly due to

Tenant repeatedly does some malpractice

            One more had once rented to be late

            Damaging properties

            Do some serious illegal activities

In some states such as Brooklyn, New York etc. landlord will use unconditional quit notices, or in other states like tenant-friendly they use pay or quit notices or cure or quit notices etc.

 

Notice for termination without cause

Landlords may take 30 day notice to vacate the tenant has not done anything wrong.Some rent controlled cities , landlords want to prove a legal reason notice for eviction of tenants

Such state has many proceeding steps for evicting the tenant like notice,lawsuit,trial etc. after all these courts will decide finally

Tenant Defenses

Tenants can move to court for point outing the mistakes in the notice or the service error done by landlords etc

Removal of the tenant

If the landlord wins the case then the landlord will get a judgment of the property, you can ask help for court for removing tenants for your property, the court will allow the sheriff to inform the notice period of tenant. If the tenant could not move within time then the sheriff will remove the tenant physically
