How can frustration derail the judgment recovery process?

by Alan M. Cohen LLC Debt Collection Lawyer in Boston

Have you been presented with a judgment against someone who owes you money? If your answer is yes, then you are likely well aware of the frustrations and inconveniences associated with the process of collecting your judgment. That being said, allowing frustration to overwhelm you during the collection process will do nothing but hamper your chances of successfully recovering the debt.

It is estimated that anywhere between 80 and 85 percent of all awarded judgments are either uncollected or not collected promptly as court systems cannot force debtors to pay. One reason such a large amount of court awarded judgments go uncollected is the lack of knowledge on the part of individual judgment creditors. Although the courts do provide creditors with the power to collect the money owed, they do very little with the enforcement part of collecting the judgment.

Herein lies the reason why the process of debt collection is often very frustrating and discouraging. Your enforcement and collection are your responsibility, and apart from awarding a judgment in your favor that states you are entitled to the money owed by the debtor, the court cannot provide you with any more help. The court will, however, allow you the access to tools that can be utilized to help in the collection of money owed. These tools come in a variety of forms such as wage garnishment, bank account levies and property liens. Although these tools are readily available with the full authority of the court system to be used by you, you may not know how to correctly implement them (if at all).

So, if you are not aware of the collection process and/or do not have the time to invest in your judgment enforcement or collection process, you can consider assigning the judgment collection to a professional attorney that specializes in recovering debt for individual judgment award winners. Seeking out professional assistance will certainly help you avoid frustration often associated with collecting money that you are owed.

A big challenge is to find a professional and effective collection attorney so that neither your time nor your energy is wasted. You can scour the internet to find judgment collection attorneys in your area. When you have shortlisted a few, talk to them personally and select the one based on the fee charged, experience and previous success rates.
