NJ Family Leave Act in Greenwich Township: Your Right to Take Time Off

Balancing work and family is never easy, especially during major life events. Fortunately, New Jersey law gives you the right to take job-protected leave to care for your loved ones. If your employer has denied you that right or retaliated against you for using it, Castronovo & McKinney, LLC is here to Protect Your Rights and make sure you’re treated fairly under the New Jersey Family Leave Act (NJFLA).
What Is the New Jersey Family Leave Act?
The NJFLA allows eligible employees to take up to 12 weeks of unpaid, job-protected leave in a 24-month period to care for a family member with a serious health condition or to bond with a new child. Unlike the federal FMLA, which covers your own health issues, the NJFLA is specifically for family care needs.
Who Qualifies?
- You must have worked for your employer for at least 12 months
- You must have worked at least 1,000 hours during the previous 12 months
- Your employer must have 30 or more employees (including out-of-state employees)
If you meet these criteria, you are entitled to leave without fear of losing your job or benefits.
Reasons You Can Take NJFLA Leave
- To bond with a newborn child within the first year of birth
- To care for a newly adopted or placed foster child
- To care for a family member (child, parent, spouse, civil union partner, domestic partner, parent-in-law, sibling, grandparent, or any blood relative in your household) with a serious health condition
Common NJFLA Violations by Employers
- Denying leave to eligible employees
- Terminating or disciplining employees for taking leave
- Refusing to reinstate employees to their prior position
- Misrepresenting employee rights or eligibility
- Retaliating against employees for requesting or using leave
Any of these actions may entitle you to legal relief, including reinstatement, back pay, and damages.
