5 types of IPR in India
Intellectual property rights is the basis of
development in a design, magazine article, artwork, book, or a new way of
manufacturing something. There are multiple forms of intellectual property. The
term ‘property’ implies ownership by another person or organisation. For
instance, if a producer makes a film, it becomes intellectual property.
There are different types of IPR. You get protection
under the law in India. If someone copies your movie, you can sue that entity
and get restitution. You also get compensation for the same. Here are the
details:
Patents
They are the most important. They are a government
license or authority conferring a title or right for a set period. It applies especially
to the sole right to exclude others from making, using or selling an invention.
There is a process on how to get
patent in India.
When people or organisations invent or come up with
something new, they approach the patent office, give them the details about the
product or process, and get protection for their property for a fee. Patent
protection is provided only for a limited period, like 10 or 20 years.
Trademarks
These
represent a brand or company’s standing to consumers, assuring a certain
standard and quality. Intellectual property protection is essential for
trademarks because companies invest time and money in developing brands. The
last thing on their minds is an imposter selling products or services using
their trademarks, deceiving consumers, and leading to losing money and
reputation.
Copyright
Whenever
you watch a movie, buy a DVD or a book, you come across the phrase ‘All Rights
Reserved.’ It is a way of protecting the contents, indicating copyright held by
the publisher. No one can copy it or use the material in any form without their
consent. You get a copyright for original work, whether a movie, book, computer
software, music, or painting.
Moral
rights give authors the power of identification as authors of a particular work
and to object if presented in a distorted or mutilated form. Economic
freedom is more tangible and gives the author the right to control the use of
their creation and reap financial rewards from it.
Industrial
design
It
is one of the types of IPR defining a production technique of a specific
product or article. For instance, a furniture company invents a new way of
making sofa or beds and protects the rights so that others do not copy them.
Geographical
indication
Certain
products belong to a geographical location. Producers need intellectual
property protection to ensure products from other areas do not misuse the
indicator. For example, Basmati rice is a product with a geographical
indication registered under the Department of Commerce in India. This tag only
applies to the rice variety grown in seven states of the foothills of the
Himalayas.
