Texas Roadhouse is facing yet another slip
and fall lawsuit due to the debris on restaurants floor caused by the free
bucket of peanuts offered to customers.
In February 2015, an Iowa man was out at the steakhouse much
like the one in Salt Lake City when he had his accident. This man’s fall
resulted in his knee shattering in four places. The man’s lawyer is looking to
get him payment for physical impairment, medical expenses, loss of earning
capacity and punitive damages.
This isn’t the first time that Texas Roadhouse has faced a
slip and fall trial. In 2008 a woman received $43,000 for her fall, and in 2013
another sought over $1 million for her injuries and the long-term damage it
caused for her.
The lawyer in this case suggests that the peanuts are a
“marketing gimmick” that is perpetuated by employees who encourage making a
mess of the floor by adding to it. His attorneys suggest that it’s a very
dangerous environment, because the flooring doesn’t absorb any of the natural
oils from the peanuts.
This case is leaving the people of Salt Lake City asking if
the peanuts are even worth it.
On the opposing side, the Texas Roadhouse public relations
people state that the peanut waste is “open and obvious”. They have signs on
the doors about the peanuts, intended for those suffering from extreme peanut
allergies. Nonetheless, patrons are aware of the food from the second they
enter the restaurant.
The goobers are part of Texas Roadhouse’s identity,
something that makes them unique, and their lawyers support them in their
decision to not get rid of the staple any time soon.
While nothing at this scale has happened in Salt Lake City,
it’s always a friendly reminder to stay aware and avoid the looming slip and
