What type of Car Problems qualify Under State Lemon Law?

by Andrew Richardson allenstewart

Is your new vehicle failing to perform as it should? Have you taken it to the dealership and manufacturer suggested mechanic shop only to return in vain? Well, we guess you have a lemon in your hand.

Luckily, you don’t have to worry about owning a defective (lemon) vehicle because the state’s lemon law gives the customer the right to act upon the matter to obtain a rightful claim for the same.

But, if you are still confused about what car problems fall under “substantial defects,” then here are a few examples.

1- Airbag defects

Airbag defect is one of a kind issue that substantially impairs your safety in the car. No matter if the problem prevents the airbag from deploying on time or makes the airbags come out in a manner that is more dangerous than it coming out at all. Your vehicle can qualify under the state’s lemon law if it has an airbag defect in it.

2- Seatbelt defects

Similar to how an airbag defect impairs your safety, a defective seatbelt does the same. Defective or unreliable car seatbelts can have drastic repercussions during accidents. A person can easily get fatally hurt just due to a defective seatbelt; therefore, such a defect is easily considered under the state’s lemon law.

3- Electrical defects

Electrical defects can be as simple as an improper connection between two wires. But, if the manufacturer or car dealership isn’t able to fix the issue even after reasonable repair attempts, then the defect can be something much larger.

Many electrical defects can have serious implications and can even grow over time. In fact, electrical issues are one of the common sources of fire in the car.

4- Brake and acceleration pedal defects

Controlling speed is one of the biggest aspects of driving a vehicle. If the brake and acceleration pedals are preventing you from properly controlling the speed of your vehicle, then that is going to cause a lot of problems.

So, by all means, these defects are qualified under the state’s lemon law to raise car’s complaint

5- Paint defects

Keep in mind, substantial defects not only mean a defect that hampers your and others’ safety. It also means that the defect impairs the “use” and “value” of your vehicle.

A terrible paint job can significantly reduce the value of your vehicle. Even though paint defect isn’t a serious problem, but it can qualify you for a replacement vehicle or a refund of your purchase price on the vehicle.
