The Up Side of a Settlement

Right now, it is likely that there are hundreds of thousands of plaintiffs and defendants that are currently going through personal injury cases nationwide. Fortunately, most of these cases will not make it to trial thanks to the state and federal courts as the vast majority will settle. This article will discuss some of the reasons why many personal injury cases end in settlement.

There are several reasons why many personal injury cases settle rather than go to trial; some of these reasons include the following:

  • Uncertainty - Any litigation process is full of issues that make for uncertainty. Surprises can come at any moment, especially during the phase referred to as the discovery phase. The discovery phase is the process of gathering information in preparation for trial whereby the plaintiff and the defendant exchange information about witnesses and evidence. During this process, investigators may stumble upon crucial pieces of evidence or plaintiff fumbles and says the wrong thing during a deposition. One way of avoiding uncertainty is by settling one’s case.
  • Saving money - The reality is that litigation is an expensive process, especially in personal injury cases requiring expert witness. Expert witnesses are very precious with their time, and their time is extremely valuable. Some activities that they include in their costs are preparing reports, travel time, and time spent testifying. Some lawsuits will require the use of more than one expert witness just for one side. 

      Another element that makes litigation expensive is that it takes up a lot of the attorney’s time. If the case goes to trial, an attorney may spend thousands of hours preparing various documents, analyzing and reviewing documents and or pieces of evidence, preparing witnesses and arguing motions in court. This all translates to a very large bill for attorney fees.

  • Save time - The full process from start to finish of pursuing a personal injury lawsuit up to the point of a verdict can take one year to several more years. Even if the plaintiff wins the trial after all those years, there is a likelihood of the defendant appealing the outcome of the trial. The appeal itself can add a few more years to the time taken to complete the case.
  • Privacy - Courts are public; therefore, anyone can observe what is happening in most proceedings. When a personal injury lawsuit goes to trial information that may previously have been private may become available to the public, for anyone who takes an interest. On the other hand, a settlement provides some level of privacy; for example, the plaintiff may want to keep sensitive medical information private and this is possible through a settlement. Or an organization may want to save face on company issues relating to employee conduct or a defective product from making headlines; this is also possible by way of a settlement.
