1 – What Vehicles Does Texas Lemon Law Cover?

It includes new cars, trucks, vans, motorcycles, all-terrain vehicles, motor homes, towable recreational vehicles (TRVs), and neighborhood electric vehicles that develop defects or defects covered by the manufacturer's written warranty.

The law does not cover recalled vehicles, boats, or agricultural vehicles. Plus, it does not cover defects that do not substantially affect the vehicle's use or market value, such as minor rattles, dents, etc.

There are certified provisions in prevailing state laws for used vehicles. Texas law relating to warranty performance may cover your used vehicle if the manufacturer's original warranty still covers it. But it does not apply to an extended warranty or service agreement. 3 – What security threats does Texas Lemon Law cover?

Your vehicle should have a serious defect that proves to be life-threatening or significantly impairs the driver's ability to control or operate it safely. Or, it creates a fire or explosion risk and causes the driver to attempt repairs two or more times during the first two years, 24,000 miles, or before the warranty expires, whichever is earlier. 

4 - What is a 30 Day Test under Texas Lemon Law?

Suppose a vehicle undergoes repairs during the first 24 months, 24,000 miles, or for a total of 30 or more days before the warranty expires, whichever occurs first, and the problem persists. In that case, you can claim relief under Texas Lemon Law. You may be eligible for relief under Texas Lemon Law if defects reduce the market value and use of the vehicle.

5 - When can you file a Lemon Law complaint?

You must file a lemon law complaint within six months. You can file a complaint within the expiration of the express warranty period or twenty-four months after purchase, or 24,000 miles following the date of original delivery of the vehicle. The filing period depends on which event happens first. Ideally, one should file a complaint as soon as one knows that the dealer has problems repairing the vehicle.
