So, What’s The Legal Situation With Vaping And Driving?

Anyone who’s spent any time vaping can testify that it’s a brilliant activity to undertake in a wide range of settings – it’s certainly more socially acceptable for smoking, for a start! Indeed, the sheer versatility of vaping goes a long way to explaining why more than three million of us now do it here in the UK.

However, you unfortunately can’t vape absolutely anywhere – for your own good, as much as everyone else’s – although there are certain situations that might seem ambiguous.

Take driving, for instance. Is it really that big a deal to have a cheeky vape behind the wheel, as long as you’re still in control of your vehicle and have your eyes fixed firmly on the road ahead?

As reported by The Star and other publications recently, it isn’t technically illegal to vape while driving. However, if you are seen to be distracted by the use of an e-cigarette when behind the wheel, the consequences could be very severe indeed, including a fine running into thousands of pounds, potential penalty points and maybe even a ban.

Why could you face such a seemingly draconian punishment? Well, police have said that fatal crashes could potentially occur due to drivers being momentarily blinded by the considerable smoke produced by e-cigarettes.

Sergeant Carl Knapp of the Sussex Road Policing Unit has previously said of vaping while driving: “I strongly advise people to pay 100 per cent attention to the roads when driving as anything that takes that attention away has the potential of severe consequences.

“If you are going to vape I advise that you open your windows and blow the vapour directly out, just ensure that you are in full control of your vehicle before doing so.”

His words were backed up by a spokesperson for the Department for Transport (DfT), who stated: “We believe that drivers should always follow the rules set out by the highway code and must always exercise proper control of their vehicle and avoid any distractions, including vaping.”
