The Basics

There are various instances where the rules of personal injury can be applied:

Accidents: Accidents occur due to negligence and carelessness. Personal injury rules apply in such situations such as accidents, slips, medical malpractice, dog bites, etc.

Intentional Acts: When a person intentionally causes harm to another person, the personal injury rule is applicable. Assault, harassment, etc. are included in this category.

Defamation: When a person defames another person through statements, and if it causes harm to the individual with damage to his reputation, personal injury rules are applicable.

Defective Products: In certain situations, defective products can cause damage to a person. This can intentional or can be a result of negligence. Regardless of the reason, personal injury laws are certainly applicable in all such instances.

The Law

Common law rules are the ones that are used as a base in personal injury cases. This law was established by judges, unlike today where laws are established by passing bills in senates or through legislature.

Common law differs according to states; however, they are not the single source of personal injury laws. Formal legislations have been passed and certain statutory laws have been established on the basis of personal injury issues.

Additionally, there is statute of limitations for personal injury laws. According to this, there’s a limit people have to file a lawsuit in their civil court.  

How does the Law Work

The defendant and plaintiff can either settle the case in court, or can opt for out of court settlements as well.

Depending on the type of breach, actions are taken by the court. If it is decided that the matter is going to the court, each party will have to hire a lawyer to handle their cases. Even after the lawsuit is filed, settlement negotiations can continue until the case reaches the civil court for hearing.
