What is RCMC Registration?

RCMC Registration is a certificate required to be obtained by the export and import companies or firms and to avail benefits and concession under India's Foreign Trade Policy.

Essentially, RCMC stands for Registration-Cum-Membership Certificate, and it's a license which is issued by the competent government authority. Those exempted under the Export-Import Policy, aren't required to obtain the certificate or get RCMC registration done.

The Validity of RCMC Registration

The validity of RCMC registration is up to 5 years and shall be as follows:

From 1st April of the licensing year (the year of issuance of license) up to the next 5 years ending 31st March of the ending year, unless specified.

What are the Competent Government Authorities for RCMC?

·   Federation of Indian Exporters Organization (FIEO) or a relevant Export Promotion Council (EPC) can issue the certificate of RCMC.
· A status holder can obtain the RCMC registration from Federation of Indian Exporters Organizations (FIEO).
·   Exporters of forest produce and value-added products can also obtain RCMC registration but from Shellac and Forest Products Export Promotion Council (SHEFEXIL).
·   Software exporters need to register themselves with Electronic and Computer Software EPC (ESC).
· The applicant can obtain the RCMC registration from FIEO only if the export product is not covered by any EPC.
·   There are 14 listed services that need to register with services EPC whereas other service exporters need to register with FIEO.

For whom is it mandatory to obtain RCMC Registration?

Each and every person applying for:

· An authorization of importing or exporting restricted items, or
· Any individual applying for some benefit or concession under Foreign
Trade Policy (FTP) such as duty drawback, duty credit scrip, etc.

Certificate of Registration as an Exporter of Spices issued by Spices Board must be treated as RCMC. Furthermore, no other RCMC should be applied to any other Export Promotional Councils.

Reports to be furnished by the Exporters

Exporters are supposed to furnish the following reports to the concerned EPC:

· Reports on quarterly returns;
· Details of their exports.

However, the status holders can submit the reports on quarterly returns to the FIEO in a specified format.

How to intimate changes in Constitution?

There can be any change in any of the following described parameters:

·         Name;
·         Constitution; and
·         Ownership or address of an RCMC holder.

In such cases, it is mandatory for RCMC holders on their part to intimate the specified changes to the registering authority within a period of one month from the date of occurrence of such changes.

In case the exporters delay the intimation, the registering authority may accept the same if there's a genuine reason for the delay. The exporters must submit the necessary evidence that justifies the delay.

What are the provisions regarding the cancellation of RCMC Registration?

In case the RCMC holder has violated the conditions of registration, the registering authority holds power to cancel the RCMC registration of the holder.

But before de-registration, the registering authority offers an opportunity to the RCMC holder to make a representation against the proposed de-registration and justify the action responsible for the same.

The accused party can appeal against de-registration within a period of 45 days from the decision of de-registration. The decision of the appellate authority shall be the final one.
