How to set up Shakes & Smoothies Shop?

Opening a stand-alone shop or a chain of shops, some registrations and licenses are required to be obtained before or just after starting the shop. They are:-
Registrations
A. Register the business as a legal entity. Depending on the scale of operation, a shop selling shakes and smoothies can be registered either as a Private Limited Company, a One Person company, a Partnership Firm or a Limited Liability Partnership Firm.
B. Obtain the Trademark registration for maintaining the unicity of the brand.
C. Apply online for registration under Goods and Services Tax.
D. Obtain the Udyog Aadhaar Number from the Ministry of MSME.
E. Shop and Establishment Act registration is mandatory within 30 days of starting operations of the business. Documents that need to be submitted are - list of employer and manager names, establishment name, address, category, and applicable fees.
Licenses
a. FSSAI Food License - As per the Food Safety Standards Act, 2006 and FSS Regulations, 2011, all eligible food business operators like food manufacturers, storage units, transporters, retailers, marketers, distributors, relabellers etc. need to get their business licensed from the Food Safety and Security Authority of India (FSSAI). There are three different categories of licenses/registrations under the Act and the FBO needs to identify the applicable license/registration based on his business’ annual turnover and installed capacity.
For the food manufacturer specializing in making and selling shakes and smoothies, the FSSAI basic registration should be enough to start with. The license can be procured for a period ranging from one year to five years. In case of any modification with growth in business, the FBO can apply through the FSSAI online site and get the license changed or renewed.
The online process for basic registration include:-
• Register on the FLRS (Food Registration & Licensing System)
• Log in using the registered username and password
• Click on ‘License/registration’ and then click on ‘Apply for license/registration’
• Tick on the undertaking
• Select the state of operation
• Fill in the address of the shakes & smoothies premises
• Select ‘No’ for premises in more than one state
• Select the kind of business
• Select capacity or turnover
• List out the product category details
• Provide details of the person in charge of operations and his contact details
• Upload all necessary documents
• The fees need to be paid physically for the basic registration and details need to be uploaded online
• Take a printout of Form B
• Upload the signed copy of the Form
On completion of the above process, an acknowledgment will be sent bearing the application reference number. Using this number the FBO can check for the status online of his application.
The supporting documents that need to be submitted along with Form-B to obtain the basic registration are:-
• Photo Id proof of the promoters/partners
• Address proof of the promoters/partners
• Ownership proof or lease agreement of the said premises
• Partnership Deed or Certificate of Incorporation
• List of food products that would be manufactured or processed or stored
• Food Safety Management system plan
The important thing to remember is that no food business entity can run its business in India without the FSSAI license/registration. In case of non-compliance to prescribed standards, there’s a huge penalty that the FBO needs to pay.
b. Health License from the State Health Department or the Municipal Corporation
c. Eating House license, if the shop has seating arrangements for people to consume the shakes and smoothies within the premises of the business.
d. A NOC from the State fire department
e. Signage License from the Municipal Corporation to set up signages, posters, pictures, logos, and symbols in order to inform the public.
