How to rent a room of a house, how it is declared and model of contract

Advantage

How to rent rooms

The lease of rooms is regulated in the Civil Code and not by the LAU as in the case of housing. This implies that there is no right to forced extension as in the case of the total rental of a home. That is to say, that the duration of a room rental will be exactly that which appears in the contract.

It also means that if it is not stipulated otherwise in the room rental contract, the tenant can sublet it, without the need of authorization from the owner/lessor. And if the house is sold, the rental contract for the room is automatically extinguished. The tenant of a room has, in this case, fewer rights than the tenant of a dwelling in its entirety. Nor has preference in the acquisition of such housing.

How to rent a room

The landlord must declare to the Treasury, in all cases, the benefits obtained from the lease of one or more rooms. But the following amounts may be deducted in the Declaration of the Income of the Individuals:

100% in the case of tenants between 18 and 30 years and a net income higher than the value of the Iprem.

If the owner already deduct his mortgage from the home in the Income Statement, the value of the reduction will decrease when renting rooms. On the other hand, the tenant of a room cannot deduct anything from his Declaration of Income since it is not considered "rent of habitual residence".

To write a contract to rent rooms, you must be as specific as possible and include all the details regarding the price, the method of payment, the exact room and the services to which the tenant is entitled or whether or not supplies in the price.
