How to claim compensation

Accidents happen every day. If it was caused by someone else, you could claim compensation for your injuries. A personal injury may be physical or psychological in nature and is usually caused by a motor vehicle accident, work-related injury, slip and fall accident in a shopping mall, accidents on school grounds, or any other public place. You may even claim compensation for products that are faulty, causing injury.

Here are the steps for how to claiming compensation:

1.  Collect evidence

Whenever you're involved in an accident, it is important to collect evidence, even if you're not sure that you want to claim compensation yet.  This would include taking pictures, collecting names and phone numbers, and witness reports.

2.  Seek medical attention

Again, whether you've been injured or not, be sure to seek medical attention. Motor vehicle accidents can cause whiplash days - sometimes even weeks - after the fact. Let your doctor know that you were in an accident and be sure that it is noted on your medical record.

3.  Write out a statement

As soon as you can, write out a statement of what happened while it is still fresh in your mind. As time progresses, you may forget important facts.

4.  Discuss your case with a personal injury specialist

Once you have decided to make a claim, you need to get in touch with an expert in personal injury law. You need to make an initial appointment, which is generally free. During this appointment, the lawyer will assess the merits of your case and see whether you are entitled to a claim. If your lawyer doesn't work on a contingency basis, he will discuss his fee structure with you.

5.  Ascertain the value of your claim

Your personal injury lawyer will follow a complex formula to determine the compensation due to you. It will include medical bills since the accident, future medical bills, lost wages or earnings, cost of care, loss of financial support, traveling expenses and more.

Additional expenses, known as "general damages" include compensation for pain, suffering, and shock due to disability, disfigurement, loss of amenities of life, and a shorter life expectancy. General damages are usually limited to serious injuries. Your claims will be assessed by a registered medical practitioner to validate that it falls into the 'serious injury' category.
