Surrogacy:A Path Towards Parenthood for Infertility Couples

Surrogacy is a kind of practicing treatment which is the most common type of treatment these days.

Surrogacy is controversial inside the nation and also among the world wide, having difficulty in facing the issues relative to moral, social and legal factors to be made with the best prompted treatment for the infertility to be made effective. Gestational Surrogacy

Gestational Surrogacy is one of the type of surrogacy and most relative and proclaimed practice which becomes legal in most of the countries these days as most of the people from different countries are facing the issues of infertility these days which is barely around 30% and many people should be using it very commonly to get rid of the infertility issues and its scenarios. In such kind of practice, at least one or both intended parents are involved to make the laws legalized and make the biological relationship with the child in one way or the other.

Surrogacy Agencies

There are so many countries where surrogacy is most commonly used and practiced and so formed some agencies where these kinds of practices are performed well.

These agencies have some woman's which are indulged in these kinds of practices and the intended parent’s eggs and sperms should be fertilized and then the fertilized embryo transferred into the surrogate mother's womb and all the process is legally operative and after delivery there is no right of the surrogate on the child and all this should be monitored by the surrogate agency and after handling the child to the parents, work of surrogacy agencies should be at the end as per the need of the contract.

LAWS RELATED TO SURROGACY

Surrogacy arrangement will continue to be governed by the contract amongst parties, which will contain all the terms and conditions requiring for the consent of the surrogate mother to bear the child, agreement of her husband and other family members for the same treatment to be defined.

·         A surrogacy contract should be necessarily taken care of the life insurance for the surrogate mother to be given by the intended father in case of any complications to be faced up by the surrogate during pregnancy period.

·         One of the intended parents should be a donor as well whether mother should donate her eggs or may be the father’s sperms are being used for the procedure to be completed, so as to create the bond of love and affection with the child primarily emanates by building the biological relationship.

·         Legislation itself should recognize a surrogate child to be the legitimate child of the commissioning parents with all the legal formalities must be performed in such respective.       

·         The certificate issued by the hospital at the time of birth of the child should contain only the names of the commissioning parents and no other name is being mentioned elsewhere.

·         Right for the privacy of donors should be protected.

·         Sex-selective surrogacy should be prohibited now a day in most of the countries.
