Surrogacy Laws in the India - An Overview

by Shivani Sachdev Founder & Director

Surrogacy in India has opened new opportunities for the couples to get blessed with a baby. As compared to other countries, India offers better services and that at lesser cost. This is the reason that not only Indian couples from outside India also get attracted. This has definitely brought a boost in the market of surrogacy. More clinics and hospitals have been set up so that the requirements of the couples can be met. Though surrogacy became legal in India in the year 2002, a lot has been seen and experienced. Unethical practices related to surrogacy have increased and this is the question of worry for the government.

There is no denial to the fact that surrogacy has helped many couples and still a big hope for many but the kind of activities that have come up are really disturbing. More and more clinics are being set up to seek the attention of the couples and surrogates are asking for huge amounts. Then there are those who are being put into this business forcibly. So a question arises that how to improve this field and what can be done for the women who are facing problems while getting into surrogacy.

Strict surrogacy laws – Though the government is quite strict with surrogacy but still the misuse of the same is going on. Therefore the women will have to come up for the same and only then it is possible to punish the culprits. The number of hospitals and surrogacy centres are too many in India that it is tough to monitor all the activities going around. So the parents or the surrogate whosoever has faced problems can come up for justice as government takes such cases very seriously.

Put a stop to new surrogacy centres – Presently there are about 3000 centres in India with most of them being successful. It is because of the simple reason that couples from other countries come to India for surrogacy owing to the low surrogacy cost in India and easy availability of the surrogates. All this makes India the best place for surrogacy. But efforts should be made to ensure only reputed and reliable clinics. Strict guidelines should be laid down and followed by the hospitals. If not they should be shut down no matter what the reason is. Dr Shivani Sachdev Gour is one of the best surrogate hospitals in delhi with trusted doctors and competent staff to help you.

Regulate surrogacy process – A lot of outsiders are coming to India and this has drastically increased the demand of the surrogate. Women are doing it for the sake of people and this has increased the corruption. So some kind of regulation as well as constant monitoring needs to be done or else the conditions can become worse. Things are going on the wrong track as surrogacy needs to be a compassionate task not something that should be forced. If the surrogate is willing to do it, the couple should move ahead or else leave it.

Therefore surrogacy should be seen with a different perspective and it is necessary to bring down the illegal practices.
