& Climate Change, New Delhi notified Plastic Waste Monitoring Policy, 2016
vide notice no. G.S.R. 320 (E) outdated 18.03.2016 to give a governing
framework for monitoring of plastic
waste management authorization in the country. These guidelines will apply
to every waste generator, neighborhood body, Gram Panchayats, manufacturers,
Importers, manufacturer as well as brand-owner.
The waste generator shall take actions to minimize
generation of plastic waste and also segregate plastic waste at source based on
the Solid Waste Monitoring Policy, 2016 or as changed now and then and not
clutter the plastic waste and make sure set apart storage of waste at source as
well as handover segregated waste to the metropolitan, regional body or gram
panchayat or agencies designated by them or signed up waste pickers',
registered recyclers or waste debt collection agency.
All institutional generators of plastic waste will
segregate as well as store the waste generated by them according to the Solid Waste
(Monitoring) Regulations, 2016 and handover segregated wastes to accredited
waste handling or disposal centers or deposition centers either by itself or
via the accredited waste collection agency.
Every person responsible for arranging an occasion in
open space, which includes service of foodstuff in plastic or multilayered
product packaging will set apart and manage the waste produced during such
circumstances based on the Solid Waste (Administration) Guidelines, 2016.
Plastic Waste Management

Plastic waste, which can be recycled, shall be

satisfy the Indian Requirement: IS 14534:1998 labelled as Standards for
Recycling of Plastics, as modified from time to time

The obligation
of the local body
( 1) Every local body shall be accountable for
advancement as well as setting up of infrastructure for segregation,
collection, storage, transportation, handling as well as disposal of the
plastic waste either on its own or by engaging firms or producers.
( 2) The neighborhood body will be accountable for
setting up, operationalization and co-ordination of the waste administration
system and for carrying out the connected functions, specifically:-.
( a) Making sure segregation, collection, storage,
transportation, processing and also disposal of plastic waste.
( b) making sure that no damages are created to the
setting during this process.
( c) making sure channelization of recyclable plastic
waste portion to recyclers.
( d) ensuring processing as well as the disposal on a
non-recyclable fraction of plastic waste in accordance with the guidelines
issued by the Central Contamination Control Board.
Thermoset plastic waste will be processed as well as
gotten rid off based on the standards rule issued from time to time by the
Central Air Pollution Control Board.
( d) The inert from recycling or processing facilities
of plastic waste will be thrown away in compliance with the Solid Waste
Administration Rules, 2000 or as amended once in a while.
( 3) The regional body for setting up of a system for
plastic waste monitoring shall seek the assistance of manufacturers, as well as
such system, will be established within one year from the date of last
publication of these rules in the Authorities Gazette of India.
( 4) The neighborhood body to structure bye-laws
integrating the arrangements of these regulations.
Responsibility
of Gram Panchayat
(1) Every gram panchayat either by itself or by
engaging an agency shall set up, operationalize and co-ordinate for waste
administration in the rural area under their control and for carrying out the
connected features, namely,-.
( a) guaranteeing partition, collection, storage space,
transport, plastic waste and channelization of a recyclable plastic waste
fraction to recyclers having valid registration; ensuring that no damages are
created to the atmosphere during this process.
( b) creating understanding amongst all stakeholders
regarding their responsibilities; and also.
( c) making sure that the open burning of plastic waste
does not take place.
Duty of waste
generator
(1) The waste generator shall:
( a) take steps to reduce the generation of plastic waste
and also segregate plastic waste at source according to the Solid Waste
Monitoring Rules, 2000 or as changed from time to time.
( b) not litter the plastic waste and also ensure set
apart storage space of waste at resource and handover set apart waste to the
urban regional body or gram panchayat or companies selected by them or signed
up waste pickers', signed up recyclers or waste debt collector.
(2) All institutional generators of plastic waste,
shall set apart and store the waste created by them based on the Local Solid
Waste (Administration and Handling) Guidelines, 2000 informed vide S.O. 908( E)
dated the 25th September 2000 under the Act or amendment every so often and
handover set apart wastes to accredited waste handling or disposal facilities
or deposition centers either by itself or via the accredited waste debt
collection agency.
Duty of
Producers, Importers and Brand Name Owners
(1) The manufacturers, within a period of six months
from the date of a magazine of these regulations, shall work out techniques for
waste collection system based upon Extended Producers Obligation and including
State Urban Growth Departments, either independently or collectively, via their
very own circulation network or through the regional body worried.
(2) Key duty for collection of used multilayered
plastic sachet or pouches or packaging is of Producers, Importers and Brand
Owners who present the products out there. They need to develop a system for
gathering back the plastic waste produced due to their products. This strategy
of collection to be submitted to the State Contamination Control Boards while
making an application for Grant Develop or Run or Renewal. The Brand Owners
whose authorization has been restored before the notification of these regulations
shall submit such strategy within one year from the date of announcement of

(4) The manufacturer, within a period of 3 months from
the date of the final magazine of these rules in the Authorities Gazette shall
apply to the Air pollution Control Panel or the Contamination Control
Committee, probably, of the States or the Union Territories administration
concerned, forgiving of registration.
(5) No manufacturer will on as well as after the expiry
of a duration of Six Months from the day of the final magazine of these rules
in the Authorities Gazette manufacture or make use of any plastic or
multilayered packaging for product packaging of assets without registration
from the concerned State Air pollution Control panel or the Air Pollution
Control Committees.
(6) Every producer shall maintain a record of details
of the individual participated in supply of plastic utilized as the primary
material to produce carry bags or plastic sheet or like or cover made of
plastic sheet or multilayered packaging.
Registration of
producer, recyclers and manufacturer
(1) No
individual shall make lug bags or recycle plastic bags or multilayered
packaging unless the person has actually acquired a registration from the State
Contamination Control Board or the Pollution Control Board of the Union Region
concerned, probably, before the start of production.
(2) Every producer or brand-owner shall, for the
objective of enrollment or revival of registration, make an application, in
Type 1 to,-.
( i) the worried State Pollution Control panel or
Pollution Control Board of the Union region, if operating in a couple of states
or Union areas; or.
(ii) The Central Air Pollution Control Board, if
operating in greater than 2 States or Union Territories.]
(3) Everyone recycling or refining waste or suggesting
to recycle or refine plastic waste shall make an application to the State
Pollution Control Board or the Pollution Control Board, forgive of registration
or revival of enrollment for the recycling unit, in Type II.
(4) Every supplier took part in a maker of plastic to
be used as resources by the producer shall make an application to the State
Contamination Control Board or the Air Pollution Control Board of the Union
region worried, for the grant of enrollment or for the revival of registration,
in Form III.
( 5) The State Contamination Control Board or the Air
pollution Control Board will not issue or renew enrollment to plastic waste
recycling or refining units unless the device possesses a valid authorization
under the Water Prevention and Control of Contamination Act, 1974 (6 of 1974)
and also the Air (Avoidance as well as Control of Air Pollution) Act, 1981 (14
of 1981) in addition to a certificate of registration provided by the District
Industries Centre or any other Federal government company authorized in this
regard.
(6) The State Air Pollution Control Board or the Air
pollution Control Board will not renew the registration of producer unless the
producer possesses an action strategy supported by the Assistant in charge of
Urban Advancement of the worried State or Union Region for the setting of the
plastic waste management system.
(7) On receipt of the application full throughout for
the registration for reusing or handling of plastic waste under sub-rule (3 ),
the State Air pollution Control Board may, after such inquiry as it takes into
consideration necessary as well as on being pleased that the applicant
possesses suitable facilities, technical abilities and also equipment to handle
plastic waste safely, may grant enrollment to the applicant on fulfilment of
the problems as may be set in terms of registration.
( 8) Every State Air Pollution Control Board or
Pollution Control Committee will decide on the grant of registration within
ninety days of receipt of an application which is complete throughout.
( 9) The registration granted under this regulation
will initially be valid for one year, unless revoked, put on hold or cancelled
and will consequently be provided for three years.
( 10) State Air Pollution Control Panel or the
Pollution Control Committees shall not withdraw, put on hold or cancel
enrollment without giving the chance of a hearing to the manufacturer or person
engaged in recycling or handling of plastic wastes.
( 11) Every application for revival of enrollment will
be made a minimum of one hundred twenty days before the expiry of the
credibility of the registration certificate.
