Workers’ compensation provides insurance payments during recovery of an injured employee. The payments enable an employee to pay bills (such as a mortgage) before full recovery. These benefits should be available to any hurt worker, regardless of whose fault it was. The payments decrease gradually as the employee transitions back to work. 

If the employer did not ensure work safety thus leading to the accident, the employee can choose to file a lawsuit instead of the workers’ compensation claim.
