How to take benefit of the BBB's Auto Line Lemon Law Programme?

by Andrew Richardson allenstewart

Buying a brand-new car only to find out it's a lemon is a frustrating and disappointing experience. Cars are costly, and most people only buy new automobiles once in a while.

When you make that investment, you have the right to expect the vehicle to perform as promised by the dealer. You can be eligible for lemon law protections as well. If you find out you've been left with a lemon, you have several choices for protecting your legal rights.

A Lemon is an automobile or other vehicle that consistently fails to fulfil a quality or performance criterion. In the case of automobiles, this refers to a vehicle with a manufacturer defect that fails to reach an objective level of performance despite the owner's many attempts at repair. To be declared a "lemon," most state lemon laws require at least three fixes to the same ailment.

An overview of the Better Business Bureau's Lemon Law Program for Auto Lines

The Better Business Bureau's Auto Line lemon law program is one such alternative offered to many consumers. Here's a quick rundown of the program:

  • The service is free and available throughout the United States.

  • The initiative is meant to encourage consumers to resolve warranty issues with new vehicles.

  • Consumers with lemon law claims can benefit from the program, which uses mediation to assist them. Arbitration is used if mediation does not work.

  • The program includes professional arbitrators to hold hearings in which both the consumer and the vehicle's manufacturer participate.

  • The consumer has the choice of accepting or rejecting the arbitrator's verdict.

  • If the customer agrees to the decision, the manufacturer must as well.

  • The majority of automobile manufacturers support the initiative.

  • In most cases, a decision is made within three business days.

  • You are entitled to a refund or replacement if the arbitrator finds the vehicle to be a lemon.

However, the arbitrator must follow the manufacturer's guidelines, which can be found in the manufacturer's "Program Summary." Check your car's "Program Summary" to determine if the remedy you want is one that the manufacturer commits to offer if the arbitrator rules in your favour.

You must speak with an experienced legal attorney before going with this strategy.
