Workers compensation is a type of insurance program that is paid by an employer as required by law. This insurance coverage is provided for employees who are injured on the job or who become ill as a result of their employment duties. Who is Eligible?

There are typically three requirements that you must meet in order to file a workers comp claim. These are:

1.    Your employer must carry workers’ compensation insurance or they must have a legal obligation to do so

2.    You must be their employee

3.    The injury or illness you are filing the claim over must be work-related

What Employers are Not Required to Carry Workman’s Compensation?

This is another factor that differs by state but is usually determined by the number of employees in the business, the type of business, and the kind of work that is performed by the employees. Some states also give charities the option to opt out of the system. Employers who carry workers comp for their employees can either purchase the insurance or self-insure. Even those employers that are not required to carry insurance may do so to provide for their employees if they are injured at work and to protect their business from being sued.

Regardless of the state laws, your employer may, or may not, have worker’s comp coverage. If your employer claims to be uninsured, talk with a workers compensation attorney. Also, ask what your options are for medical treatment and whether you will need to find a workers compensation doctor for your care. An attorney will understand your need to have medical treatment as quickly as possible.

Although it may seem obvious that a person is an employee when they are working for a company, this is not always the case. They may be independent contractors or freelance workers that do not have access to compensation. If you have been told by your employer that you are ineligible for benefits, ask a lawyer about your rights.

If your illness or injury is determined to be related to work, it will probably be covered by workers’ compensation. This means that you were performing duties of your job or otherwise acting on behalf of your employer when the injury occurred. A workers compensation doctors can help to determine if an injury or illness was the result of your job. Back injuries are common in many work environments due to lifting. However, if you are hurt while bowling for the company league, your injury may still be determined as being related to your job. While it isn’t always easy to pinpoint whether a specific injury or illness is covered, a workers compensation doctor will diagnose your condition and help in determining the outcome.
