Every case is defensible

The laws are made to protect the rights of the citizens against unscrupulous practices of the lawbreakers, those who have power and authority and tend to misuse it, to promise justice to those wronged, and to maintain a peaceful society which reassures people of their safety.

 A society truly thrives when the people have faith in the legal system which delivers justice irrespective of the people involved in the cases, and the level of complications that the courts may face. Laws have been part of human civilization since the beginning of times. The earliest manuscripts that can be traced back in the human civilization are those belonging to the Vedic ages, although it is believed that even the Indus valley civilization and the Bronze age had some kind of a legal system in place to take care of the society’s wellbeing. The sources of classical Hindu law are Sruti, Smriti and acharas. Some of the most prominent Smritis are  Manusmriti, Yajnavalkya Smriti, Naradasmriti, Visnusmriti, Brhaspatismriti, Katyayanasmriti- texts that were often used for legal judgments. The Dharamashastras consisted of the topic Vyaharas which discussed laws and legal procedures. They consisted of the rules and customs to be followed, and the punishments and penance for acts committed by people which were forbidden in a virtuous land.

Laws have been required at every stage of human civilization to discourage people from committing wrongful acts or omissions. Although in ancient times, punishments often ran on the lines of barbarism, as punishments such as public hanging, stoning to death, guillotine, etc. were often adopted by people in power to instill a sense of fear among the people. But in modern times, punishments have been made keeping in mind that a civilized approach is required to punish even the severest of crimes. In fact, in India, death penalties are handed out only in the rarest of cases and the most severe punishment is generally life imprisonment. Lawmakers and justice providers have the mindset that punishments are meant to set an example for the others, while at the same time, giving a chance of redemption to the guilty. If the wrongdoers want to redeem their mistake, the courts make sure that they get fair opportunities to do so.

Every case can be defensible. The law of torts (broadly meaning law of wrongs), in fact, is based on the legal maxim ‘Ubi Jus Ibi Remedium’ which means that for every legal damage there is a remedy. In other words, when there’s an unlawful act done, there is always some provision in law.
