Company Matter Lawyer Rebuked On The Irrational Behaviour of Public Offices

Law is for everyone but it doesn't mean that anyone can take the advantage of the rights extended by the constitution for worthless and trivial issues neither significant for the government nor for the people or organisations. The 5 Paise case is a living example of how government offices/authorities are misutilising the state resources and wasting the precious time of courts which is always in great scarce for solving the rather major issues. We all are familiar with the fact that Delhi Transport Corporation annually incurs a loss Rs 1,000 crore or more which radiates how effective and efficient is the department in managing the resources and controlling the expenses. But, the small negligence of an employee is more attention raising for the department than the mammoth loss of one thousand crores annually.

It is not a cynical comment, it is a fact. You might have went through in newspapers about the 5 paise case where DTC is putting its all efforts in proving that Ranvir Singh, the terminated conductor of DTC bus services committed a big crime in charging 5 paise less from a woman traveler in the year 1973. The state run department is adamant to punish the conductor as his negligence resulted in the loss of department's revenue, though it was just 5 paise.

This serious concern induced the DTC authorities to fight with full zeal in defending the department and challenging the verdict of labour court which ordered the DTC to reinstate the accused with full wages and asserted that the punishment given by DTC disproportionate to the negligence shown by the employee. For last 41 years Ranvir Singh is fighting for his right and DTC is rigid on his stand.

It is not a matter of sympathy and emotions for the poor conductor, but can any guess who much the department had spent in the last 41 years to win the five paise battle. Of course not less than the 5 paise. According to Mr. Kislay PandeyCompany Matter Lawyer, the Supreme Court of India," The old axiom, 'justice delayed means justice denied' raises a new question in this twist, How much is the cost of justice?

In its latest affidavit filed before Justice Kohli, DTC has indicated its resolve to punish Ranvir Singh. The affidavit informs the HC that the corporation stands by its decision to dismiss Singh and won't give him back wages. The HC will take a call on Singh's fate on August 12, when it considers DTC's affidavit and review petition.
