Basic understanding of civil judgment

by Alan M. Cohen LLC Debt Collection Lawyer in Boston

When a court resolves a civil lawsuit, it gives a civil judgment. It is the final decision on the disputes between the two parties. Most of these judgments involve payment from one party to another.  Any such judgment not in support of you can come into view in the public records section of your credit report. It will bring down your credit rating or score significantly and once the judgment is entered against you, it may remain on your credit for many years to come, even if you have paid the debt.  Once you pay the debt even, your report will be updated to satisfied, and not removed permanently.

After the victory, a civil judgment creditor can use local law to collect the debt. They can even put a lien on your possessions. The creditor can schedule a extra hearing where they can make you show up in the court and swear about your assets and their locations. If you are not available for the hearing post the judgment, a warrant can be issued for your arrest. If you ignore the summon and complaint against you, you lose. Remember, civil judgments are not final until the time for appeal has terminated. Mainly, you can plea errors of law but not the accurate determinations that a trial court or jury makes. You cannot bring in new proofs. If you want to educate yourself better about this legal subject, you should take help of an attorney who is a master in the field of civil judgment and judgment enforcement.
