Advanced Company Registration Services in India

by Gaurav Bansal Company Registration Consultants in Delhi

Since digitization started to become a norm, most of the large and drawn out procedures can be undertaken in days. These procedures can either be the procurement of certain articles, the creation of a birth certificate or advanced company registration. Now, we could have said that it is just company registration, but no, because of the succinct discussion we had about digitization, “advanced” is the word we are sticking with. Moving on,

When it comes to the matter of advanced company formation services, online is the new mantra. Why?

1.       The formation or registration process is fast.

2.       It is an almost completely paperless procedure.

3.       The response times are quite fast and therefore dealing with errors can happen quite quickly.

4.       A new mode of signature-”digital signature” is applied to the company registration process that adds another layer of security to ownership.

However, you might want to look at the second point where you can note that the process is almost paperless. Why? For that, you would have to read up until the end.

The process of company registration process

The process that is going to be presented here won’t be the one that is from the perspective for the one who wants to start the company, but rather the company secretary who undertakes the entire process from your behalf.

1.       The creation of a stamp paper:

This paper entails a word file creation of a declaration that is then printed out and forwarded to you along with the following documents:

a.       INC-9: Declaration that you are qualified to become a director because there are no criminal offences from our end.

b.      DIR-2: Director’s consent

c.       Power of Attorney: Here, you would give the right to the CA who is creating your company that you are giving them the power to move along with the registration process on your behalf.

d.      NOC: No objection certificate to the Registrar of Company to show that there are no objections.

2.       The ask for documents:

Once the above documents are created, the CS in charge would pass them onto you for signature. You would attach your documents like address proof, identity proof and pan cards and pass them to the CS.

3.       Filing for DSC:

By the time the documents of step one are reaching to you, the agent/CS would apply for DSC (Digital Signature certificate) for each of your directors.

4.       The preparation of an article of association and memorandum of association:

This step happens right after the agent has gotten the hold of your documents of the first and the second steps. Here, the agent prepared the MOA and the AOA and would forward it to you for approval. Once you have approved of the articles and Memorandum, the next step shall begin.

5.       The preparation of SPICE

A spice is an all-online version of the registration form that is filled that details everything from the name of the company and the documents that are validated. Once these are filled, the next step shall begin.

6.       The form is mailed to the registrar of companies

Now that all the forms are filled and all the bells and whistles are attached along with it, the form is then forwarded to the registrar offices.

7.       The final approval:

The final process of approval involves a lot of scrutiny from the side of Registrar of Company (ROC). Now, if things go sideways and the form is not approved, a resubmission would have to be done, else, you would be mailed the registration confirmation letter that would include a 16 alphanumeric Corporate Identification Number is also provided.

Analysis of what steps are paperless and what is not

In the above steps, step 1 and step 2 are not paperless! Why? It is because initially, the documents needed from the aspirant of the Private Limited Company registration require a hard form. Why? Because the documents entailed like address proof, Identity Proof might have their online versions, but for some reason, their hardcopy is still considered a more legally viable variant.

However, the documents in the rest of the process are paperless including the final registration confirmation response given to the person; they are all digitized documents.

That being said, even an inclusion of online element is a game changer. Therefore, if you are looking for a fast way to given legal legs to your business venture, advanced company registration services with an online element would suit you the best.
