Promotion of Paybox.me has been banned on APSense

In the interest of protecting The APSense network, Paybox.me is now banned from being promoted on APSense or any of the tools and add-on services provided by APSense including RevPages, groups, blogs or business centers.  This decision was made after independent investigation by APSense admins and a review of the APSense Terms of Service. http://www.apsense.com/terms.html

It is clearly stated in the terms of service that members will not use APSense to promote materials that infringe on intellectual property rights or copyright.  The name Paybox is a registered trademark of Sybase Inc.  and has been registered in the U.S. and is subject to U.S. copyright laws.  The full listing of Sybase owned trademarks can be found here.  http://www.sybase.com/files/Legal_Docs/Sybase-Trademark-Listing_071409.pdf.

The move to ban Paybox.me is being taken to protect APSense, both the reputation of the site and from possible legal ramifications.  We are taking reasonable measures to protect this site and this is not to be taken as APSense saying that Paybox.me is a scam, nor are we saying that it is legitimate.  We do have proof in hand that the name is registered and owned by Sybase Inc., and the decision was based solely on the issue of possible copyright infringement.

All content concerning Paybox.me will be removed and members are prohibited from placing any new content concerning or promoting Paybox.me on the site from this time forward.

Wincer i wish more sites would take a pro-active role in eliminating the scammers and scam sites from using their facilities, It's time to clean up the internet and it all starts with admins refusing to allow the content on their systems.

I'm glad to see this. APSense is a wonderful network and a powerful tool for all of us. I'm glad to see the reputation of the site protected. But even more importantly I'm glad to see reasonable measures being taken.

When laws like this are enforced in the US they hit you with fines for "each offense" That means that every individual posting made is a separate incident. If there's 30 Blogs mentioning this program and the owner of the trademarked content chooses to pursue legal measures, each of those 30 blogs would be a separate offense. That means that APSense could be required to pay up to the maximum fine for each blog.

And that is just the fines. It does not include any civil judgements of damages that may be awarded. Between the damage to the sites reputation and the monetary penalties there may not be any APSense left to benefit the rest of us in promoting our businesses and opportunities.
